Terms and Conditions: 1. Information on how to enter and other details contained within this promotional advertisements forms part of the terms and conditions of entry. 2. The Competition begins on the commencement date as stated on the Competition entry form and entries close at 11.59pm (AEDST) on the closing date as stated on the Competition entry form (the Competition Period). 4. Entry into the Ozremovals lnternet Directory competition (the Competition) is open to all Australian residents who reside in Australia and whose move takes place within Australia during !he Competition Period. However, the officers, management and employees (or immediate family of an officer, manager or employee) of the Promoter or any of its sub-licensees are not eligible to enter the Competition. It is the entrant's responsibility to supply their correct contact details and other information in their entry. 5. By entering the Competition, all entrants agree to abide by these Terms and Conditions and any entries not complying with these Terms and Conditions are ineligible and will be void. 6. To enter the Competition, all entrants must correctly complete the entry form in full and submit the entry on the website within the completion period. No responsibility will be accepted for late, lost or misdirected entries. No responsibility will be taken by the Promoter or its sub-licensees for late, lost or misdirected entries due to technical or any other reasons. All entries are deemed to be received at the time of receipt into the Promoter's database, and not at the time of transmission by the entrant. 7. The Promoter is not responsible for any problems or technical malfunctions of any network, cables. or lines, computer on-line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any website or combination thereof, including any injury or damage to participants or any other person's computer related to or resulting from participation in or downloading any materials in relation to the Competition. 8. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry which corrupts or affects the administration security, fairness, integrity or proper conduct of this promotion and which is not in accordance with these Terms & Conditions of Entry. Entries that are not genuine, are incomplete or late will be declared void. Any entrant who makes a false claim that they have used the removalist from the Promoter's directory will also be declared ineligible. Each entrant must enter their own details including their own name, address, postcode, contact telephone number and other details. Any entrant found to be not entering their own details will have their entries declared not genuine and therefore declared void. 9. All entrants must warrant that their entry is their own original work and agree to hold indemnified the Promoter against all actions, proceedings, claims, demands, costs, losses and expenses of every description whatsoever (including any legal costs or expenses incurred, and any compensation costs and disbursements paid by the Promoter on the advice of its legal advisers to compromise or settle any claim) incurred by, brought against, or awarded and paid by the Promoter in consequence of any breach of the warranty. 10. All entries will be judged at the premises of Ozremovals Internet Directory on the days after the closing date (the Judgment Date). The winner will be notified by telephone and/or email and the winner will also be posted on the Ozremovals lnternet Directory website within 7 days from the Judgment Date (the Notification Date). When the winner is notified, he/she will be instructed to contact the Promoter (by telephone and/or email) to redeem his/her prize. The winner must then contact the Promoter by telephone and/or email, within 14 days of the Notification Date. If the winner fails to contact the Promoter within this period, he/she will no longer be eligible to receive a prize. 11. The Promoter warrants that the competition is a game of skill and chance plays no part in determining the winner. Each entry will be individually judged based on creativity, originality and manner of expression and the most creative answer will be chosen as the winner. 12. Competition judges are nominated at the discretion of the Promoter and the Promoter reserves the right in its absolute discretion to reject any entry submitted to the Competition. 13. The prize is a reimbursement for moving costs up to $1,000 (one thousand) incurred by the winner on its moving day using an eligible removalist from the Promoter's directory during the Competition Period (the Prize). The Prize will be given to the winner as a cheque payment and cannot be taken as cash. The proof of moving and the moving costs will be required if selected as the Prize winner which may include a receipt from an eligible removalist and/or utility bills (e.g. phone, electricity or energy) in the name of the Prize winner showing the pre-moving address and post-moving address respectively during the relevant periods. Proof of moving considered suitable for verification is at the Promoter's absolute discretion. 14. In consideration for the Promoter awarding the Prize, the winner assigns to the Promoter all right, title and interest in and to all copyright in any material created pursuant to the winner's participation in any aspect of the Prize (the Works). The winner acknowledges the Promoter is free to use the Works in connection with the Promoter or the advertising or marketing thereof, in any media whatsoever throughout the world and to exercise its rights in relation thereto and the winner will not be entitled to any fee for such use. 15. All entries become the property of the Promoter and may be used for promotional or any other purposes. The Promoter is granted a perpetual free license of copyright in the entries. 16. All entrants agree to provide the Promoter or the Promoter's authorised agent with identification and/or proof of age if selected as the Prize winner or if reasonably requested by the promoter or the Promoter's authorised agent. Identification considered suitable for verification is at the Promoter's absolute discretion. 17. No responsibility will be taken by the Promoter or any of its sub-licensees for any changes in dates and/or times, cancellations or rescheduling of events or other arrangements that may prevent the prize winner from winning the Prize. 18. The Promoter reserves the right, in its absolute discretion, at any time during the Competition Period to vary, withdraw, postpone or cancel the Competition or the Prize including without limitation, in circumstances where, in the Promoter's opinion (which it shall form in its absolute discretion): (a) no entry satisfies the Competition entry requirements or the Prize requirements; or (b) it cannot conduct the Competition or grant the Prize for any other reason beyond its control. 19. In the event that the Promoter cancels the Competition or the Prize it shall not be required to grant the Competition or the Prize at any other time and the Promoter will not be liable in any way for any consequence of withdrawing the Competition or the Prize. 20. If the Promoter postpones or varies the Competition or the Prize it shall not be liable to any person for any loss or damage (including loss or damage caused by the Promoter's negligence) arising out of, or in connection with, the postponement or variation of the Competition or the Prize. Nor will the Promoter be liable for any loss, damage (including but not limited to indirect or consequential loss) or personal injury suffered or sustained as a result of the judging, running or cancellation of the Competition or the Prize. 21. Any decision of the Promoter in relation to the conduct of the Competition is binding and conclusive and will not be challenged on any grounds, including without limitation, the grounds that the Promoter failed to act reasonably, fairly, in good faith or otherwise in accordance with the principles of procedural fairness. The Promoter's decision will remain binding and final and no correspondence will be entered into notwithstanding that it can be demonstrated that the Promoter made a decision that was wrong or was based on a factual error or an irrelevant or irrational consideration. It is not the Promoter's policy to enter into negotiations with competition entrants or the winner who challenge a decision made by the Promoter. 22. All disputes, disagreements or claims in respect of the Competition will be resolved by the Manager of Ozremovals lnternet Directory. 23. It is the entrant's responsibility to inform the Promoter if their residential address, email or phone number changes during the Competition Period. 24. Prize winner is advised tax implications may arise from his or her Prize winning and he or she should seek independent financial advice prior to the acceptance of the Prize. 25. The Promoter will collect personal information about persons who enter this Competition so that those persons can participate in the Competition and the Promoter can administer the Competition. The Promoter may disclose that personal information to organizations associated with this competition. If a competitor does not provide their personal information they cannot participate in the Competition. Competitors can gain access to their personal information held by the Promoter by contacting Ozremovals lnternet Directory. All personal information will be destroyed after the completion of the Competition with the exception of personal information of Winner, which will be retained for the Promoter's future administration of the Competition. 26. Eligible removalists are listed in bold type in the area listings on the left-hand side of the webpage. The Promoter does not endorse or recommend any removalist nor will it be liable in any way in connection with the appointment of any removalist refered to on our website.
